The Building Code and Compliance
Anyone selling a property that has had building work may be asked by the potential buyer to produce some evidence of compliance with the Building Act? Since the 2004 Building Act, vendors of properties which have had building work carried out on them; find themselves increasingly being asked for compliance for the building work on their property.

The 2004 Building Act fundamental principle is that any building works carried out on a building must adhere to the building code. The building code must be complied with even if the work requires consent or not. It is important for building owners to check if the building code is applicable to even the most minor of building projects. It the building code is applicable the owner must follow and comply with the code.

In order to prove that the building work carried out on a property adheres to the building code and is in compliance with the Building Act 2004 it is usually necessary to produce a Code Compliance Certificate. The Code Compliance Certificate is issued when consent has been sought for the building work and before building has been started.

A consent will lapse however if the actual work has not been started within one year of the issue date.
